
BRITISH COLUMBIAS LAND CRISIS IS THE PRODUCT OF UNFINISHED CONFEDERSTION

British Columbia is not experiencing a sudden crisis of land, resources, or governance. What the province is facing is the accumulated consequence of decisions postponed for more than one hundred and fifty years. Each generation of government deferred the core question rather than resolving it. Each reform layered complexity onto an unstable foundation. What exists today is not a failure of one statute or one court decision, but a structural breakdown rooted in unfinished Confederation.

Whose Land Is It?
Sept 19, 2025 – Carole Taylor w/ Thomas Isaac, Cassels Brock & Blackwell LLP – Another look at the growing tension between aboriginal title and individual property rights. This issue was brought to the fore by the NDP government’s introduction of the Land Act just before the last election. It was a bit of a bombshell, as it indicated that First Nations would co-manage all of British Columbia’s Crown land – 94% of the province.
